Introduction: It is inevitable that in practice the Latin American healthcare surgical instrumentalist, occurrence of events that may trigger different result aimed to assess the responsibility of the surgical instrumentalist, as a member of a surgical team and the possibility that this professional has to avoid forgetting a foreign body inside a patient during an operation; this forgetfulness is called "surgical Oblito" by the Royal Academy of Literature. "Oblito" as "foreign body forgotten inside the patient during surgery." There are consequences of surgical oblito, and not affect the patient's health; these consequences are pigeonholed within the medical liability - little legal literature relating to the surgical instrumentalist. It is for this reason that the health institutions that offer surgical services must have a specific internal protocol and relevant actions to the presence of the event. Given that there is a responsibility and obligation to repair the damage done, should fall on all participants in the surgery, we stop at the end of Liability understanding that the damage must be repaired either in nature or by a monetary equivalent. Methods: A systematic literature search of the literature was performed using keywords (MeSH terms, MeSH and natural): foreign body forgotten, textiloma, gossypiboma, retained foreign body in the cavity, surgical equipment forgotten, and legal consequence foreign body forgotten. The search was limited considering the year of publication which was (2003) onwards. The search was conducted in biomedical databases such as Pubmed, LILACS, Scielo, Elsevier, and Ebsco Host. Academyc Google and repositories of educational institutions Results: Regarding gray literature, met search engines were used 29 articles were identified; of which were selected by the author, according to the previous criteria and limits the relevance in the subject. The analysis of these selected items relevant and material to the review study subjects was determined; topics that focus on surgical oblito, forgotten in the patient body and the responsibility of the surgical instrumentalist within this adverse event. The analysis begins in determining surgical oblito defining different objects in the study Latin American countries, where the word has different meanings oblito as "textiloma, gasoma, gossypiboma in the cavity. Among the results the influence of surgical instrumentalist and responsibility that may have on the exercise of the profession and the legal documents that can justify their good handle failure or certain responsibility, as well as the importance of creating specific protocols determined in oblito surgical containment and the importance of imaging as effective in early detection of this event in the surgical area method. Conclusions: In practice, the safety of the surgical patient is in the hands of health care professional working in the area of operating rooms, and is essential to prevent as best as possible the presence of a surgical oblito; an effective way is to count the stab pre-, trans- and postoperative textile, instrumental material, gauze, compresses and which must be identified in the other, without exception, by means of radiopaque material or other processes such as traceability. Among the innate and designated professional surgical instrumentation in any health service institution functions, is counting surgical supplies in all surgical procedures and therefore takes the diligence with the legal document of this process, the that is, the count format intraoperative material, unique registration control and monitoring in the audit of intracavitary equipment essential for the patient history requirement. Its importance determines different degrees of responsibility in this delicate work is necessary and the professional surgical instrumentation, complete this process and the legal processing of the document, taking the basic knowledge in legal responsibility, as discerning about the possible deterioration processes patient safety regarding non fill development and late in the count packs.
